Terms of Service
1. Acceptance of Terms
Welcome to Cable Creations! By accessing our services, you agree to be bound by these Terms of Service (“Terms”), all applicable laws, and regulations of Germany, and agree that you are responsible for compliance with any local laws. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
2. Copyright
The 3D renderings and models provided by Cable Creations, including all imagery, designs, and intellectual property related to these renderings, are and shall remain the sole and exclusive property of Cable Creations. The customer acknowledges that no title or ownership in the intellectual property is being transferred or assigned and this Terms of Service does not convey to the customer any rights of ownership in or related to the 3D renderings, the intellectual property of Cable Creations, or any other rights not explicitly granted here.
3. Usage Rights
The usage rights for the 3D renderings and models provided by Cable Creations are exclusively limited to the company that has made the purchase. These rights are non-transferable and do not extend to other companies, subsidiaries, or third parties not directly affiliated with the purchasing company. The use of the renderings and models for commercial or promotional purposes is only permissible within the scope and limits of the purchasing company.
3.1 Standard Commercial Rights
Upon full payment for the services, Cable Creations grants the customer a non-exclusive, non-transferable license to use the rendered images for commercial purposes such as marketing, advertising, and display on digital and physical mediums. The customer is prohibited from altering the images in any way that misrepresents or modifies the original intent of the image.
3.2 Extended Commercial Rights
Extended commercial rights allow broader usage of the rendered images and may include rights for reselling products featuring the images, using the images in large-scale advertising campaigns, or other extended uses. These rights are subject to a separate agreement and additional fees. Details of the extended rights and permissible uses will be clearly documented in the extended rights agreement.
4. Watermarking and Delivery
Images provided for preview and selection may be watermarked. However, upon completion of the purchase and full payment, Cable Creations will deliver the images without the watermark.
5. Ownership of 3D Models
The physical and digital 3D models used for creating the renderings remain the exclusive property of Cable Creations. Under no circumstances will these models be provided to, shared with, or sold to the customer. When models are created as a service for a customer, Cable Creations reserves the right to use these models for additional renderings in our shop and for publication in social media posts. Cable Creations is entitled to use all created works, including those developed as part of customer projects, for its own marketing and promotional purposes on social media.
6. Prohibition on Resale and Distribution
The customer is expressly prohibited from reselling, redistributing, or transferring the rendered images or any derivative works thereof to any third parties. The customer shall not share the rendered images with any third parties other than for the purpose of conducting their business as permitted under the Standard Commercial Rights or Extended Commercial Rights where applicable.
7. Refund Policy
Due to the nature of digital products, refunds are not possible once a purchase has been completed and the final product has been delivered. We encourage customers to review the watermarked previews thoroughly before finalizing their purchase.
8. Termination and Revocation of Rights
If the customer is found to be in violation of any terms specified in this document, Cable Creations reserves the right to terminate this agreement, revoke the usage rights granted herein, and demand the immediate cessation of use of any rendered images. The customer will be notified in writing of any alleged breach and will have a period of 14 days to rectify the breach to Cable Creations’ satisfaction.
9. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of Germany, without giving effect to any principles of conflicts of law. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the German courts.
10. Changes to Terms of Service
Cable Creations reserves the right, at our sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. The method of notification will be via email and/or a prominent notice on our website. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
By using the services of Cable Creations, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
